Title
Proposals to Extend Mental Capacity Legislation to the Criminal Justice System in Northern Ireland
Synopsis

The Department of Justice is publishing a consultation paper on proposals to extend new mental capacity legislation to the criminal justice system.

In particular, the consultation invites respondents to comment on:

  • the principles, assessments and protections to be set out in the  legislation;
  • how existing court powers in relation to compulsory detention, treatment and transfer to and from prison should operate in the context of a mental capacity-based approach; and
  • whether particular arrangements will be required for persons within the criminal justice system who retain their mental capacity but have a mental disorder and there is the potential for that person to harm him/herself and/or others.

The response to this consultation has now been submitted. Please contact the Consultation Response Team (consult@bps.org.uk) if you have any related queries.
