The Department of Justice is publishing a consultation paper on proposals to extend new mental capacity legislation to the criminal justice system.
In particular, the consultation invites respondents to comment on:
- the principles, assessments and protections to be set out in the legislation;
- how existing court powers in relation to compulsory detention, treatment and transfer to and from prison should operate in the context of a mental capacity-based approach; and
- whether particular arrangements will be required for persons within the criminal justice system who retain their mental capacity but have a mental disorder and there is the potential for that person to harm him/herself and/or others.
